The Feldman Firm Prevails on Bad Faith Claims
For the first time in Nevada, a court has adopted the Genuine Dispute Doctrine, recognizing that the mere disagreement between an insurer and an insured regarding coverage or the value of a claim does not by itself arise to the level of an actionable bad faith claim or violation of Nevada’s Unfair Claims Practices Act. This resulted in summary judgment being granted in favor of the insurer on all extracontractual claims. Igartua v. Mid-Century Ins. Co., 262 F.Supp. 1050 (D. Nev. 2017).
